This website is owned and operated by Soirées in Therapy, LLC and will be referred to as “we” and “our” in these Terms + Conditions [also referred to as “terms and conditions”]. By using this site, all visitors, referred to as “you”, “client”, “clients”, “individual”, “individuals”, “couple” and “couples”, agree to the terms and conditions on the website [“site”]. Accessing any area of this site shall be deemed as use of this site and an acceptance to the terms and conditions provided herein.

 

Our online private practice does not sell, rent, trade or otherwise externally distribute any personal information on what can be and cannot be shared by law. For more information on what can and cannot be shared by law, please see our notice of privacy policy. For additional information please feel free to reach out to us.

 

We do reserve the right to use the information for internal tracking and statistical analysis data, including but not limited to determine the number of visitors to our site, analyzing which sections are most accessed, duration of site visit, and number of return visits.

Soirées in Therapy, LLC is committed to protecting your privacy. This Privacy Statement ("Statement") has been compiled to better serve those who are concerned with how their ‘Personally Identifiable Information’ (PII) is being used online, also known as ‘Personal Health Information’ (PHI). PHI and PII will be used interchangeably throughout this thread. PII, as described in US privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read this Statement carefully to get a clear understanding of how Soirées in Therapy collects, uses, protects or otherwise handles your Personally Identifiable Information in accordance with this site.

You need not provide any personal or medical information to use this Site. Neither your personal information nor medication information will not be sold, traded, or otherwise used without your expressed written permission.

 

We may collect information about visitors to the Site in order to provide an experience that is user responsive. Your medical information is not collected through this Site. There may be forms in which you provide contact information (e.g., your name, address, telephone number, and email address) to request further information, support or enrollment into services. When consenting to receive services you will be asked to provide your credit card information for payment. Once payment is received, you’ll be asked to complete intake forms prior to starting services. These forms do ask for medical information that may be relevant to the service and are stored in Simple Practice Software System, a secure service.

 

SECTION 3. USE + DISCLOSURE OF YOUR PHI IN CERTAIN SPECIAL CIRCUMSTANCES

 

We may use and/or disclose your PHI without your consent or authorization for the following reasons:

Our responsibilities we are required to:

  • Keep your protected health information private unless authorized to give it out.

  • Allow you to read this Notice and give you a copy if you want one.

  • Update this Notice if we make changes. You may receive the most recent copy of this Notice by calling, checking the website or emailing the office.

  • Notify family and others for public health and safety purposes as required by law:

SECTION 4. HOW WE USE INFORMATION

We collect, store, and use the information for the following reasons:

Contact information: to send account holders notices related to their account, updates regarding status of services, functionality changes and other updates to our products or company; to send account administrators billing-related communications; and to send clients session notifications regarding sessions; to send newsletters to participants who opt-in, in accordance with our Terms and Conditions and applicable law.

Payments and billing information: we use this information to process payments on an account, to invoice you, and to fulfill our legal obligations for tax calculations.

Automated information: to diagnose problems with our servers, to administer our Site and services, and to prevent fraud or abuse on our Site and systems.

 

SECTION 5. PURPOSES OF DATA PROCESSING

Our purpose for collecting and using the information described above will depend on the type of information and context in which it was collected.

Consent: we send newsletters to participants that have opted in to receive those communications from us. Consent can be withdrawn at any time by updating your personal settings in your user account, or using our “Unsubscribe” option within the email newsletter. When you create an account, or use our contact form we may ask for Personal Information. Depending on the activity you are attempting to complete this may include:

  • name

  • age

  • date of birth

  • mailing address

  • gender

  • mobile number

  • email address

  • and other personal information as necessary

Contract: to provide our services in accordance with our Terms and Conditions, whether as an account holder, participant or client invited to join a session through our platform.

Legal obligation: to comply with a necessary legal obligation, a court order, or to exercise or defend legal claims, or to support our users in complying with the U.S. federal regulation, Health Insurance and Portability and Accountability Act (HIPAA).

Legitimate interests: when data processing is in our legitimate interests to do so and not overridden by your rights, such as to develop and provide our services and security; detect and prevent fraudulent activities; or determine the effectiveness of promotional campaigns and advertising.


 

SECTION 6. Security

This Site has security measures in place to protect against the loss, misuse or alteration of the information under its control. If the Site allows you to enter sensitive information (such as a credit card number) on order firms, the Company encrypts the transmission of that information using secure socket layer technology (SSL).

 

Soirées in Therapy may also at times provide information about you to third parties to provide various services on its behalf, such as providers who process credit card payments. The Company will only share information about you that is necessary for the third party to provide the requested service. These companies are prohibited from retaining, sharing, buying, selling, storing or using your personally identifiable information for any secondary purposes.

 

We will follow generally accepted standards to protect the personal information submitted, both during transmission and upon receiving it. No method of transmission over the Internet, or method of electronic storage, is one hundred percent (100%) secure, however. Therefore, we cannot guarantee its absolute security.

 

SECTION 7. GOOGLE ANALYTICS + COOKIES

We may use a tool called “Google Analytics” to collect information about use of the Site, such as how often users visit the Site, what pages they visit when they do so, and what other sites they used prior to coming to this Site. Google Analytics collects only the IP address assigned to you on the date you visit this Site, rather than your name or other identifying information.

 

Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this Site. This cookie cannot be used by anyone but Google, Inc. The information generated by the cookie will be transmitted to and stored by Google on servers in the United States.

 

Soirées in Therapy uses the information received from Google Analytics only to improve services on this Site. We do not combine the information collected through the use of Google Analytics with personally identifiable information.

 

Google’s ability to use and share information collected by Google Analytics about your visits to this Site is restricted by the Google Privacy Policy www.google.com/policies/privacy. This also applies when you register for our website, sign up through any of our forms using your email address or make a purchase on this site. Soirées is committed to keeping your e-mail address confidential. We do not sell, rent, or lease our subscription lists to third parties, and will not disclose your email address to any third parties except as allowed in the section titled Disclosure of Your Information.

 

We will maintain the information you send via e-mail in accordance with applicable federal law.

 

In compliance with the CAN-SPAM Act, all e-mails sent from our organization will clearly state who the e-mail is from and provide clear information on how to contact the sender. In addition, all e-mail messages will also contain concise information on how to remove yourself from our mailing list so that you receive no further e-mail communication from us.

 

Our emails provide users the opportunity to opt-out of receiving communications from us and our partners by reading the unsubscribe instructions located at the bottom of any e-mail they receive from us at anytime.

 

Users who no longer wish to receive our newsletter and promotional materials may opt-out of receiving these communications by clicking on the unsubscribe link in the e-mail.

SECTION 12. Governing Law; Venue; Mediation

 

This Agreement shall be construed in accordance with, and governed by, the laws of Georgia (USA), exclusive of its choice of law rules. The parties agree to attempt to resolve any dispute, claim or controversy arising out of or relating to these terms and conditions first by good faith negotiation.

 

The exclusive venue for any arbitration or court proceeding based on or arising out of this Agreement shall be Villa Rica, GA and any such award shall be binding on the parties.

 

The prevailing party or parties shall be entitled to recover legal fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled.

SECTION 13. CHANGES TO THIS NOTICE

Soirées in Therapy, LLC may change the Terms of this notice at any time. You acknowledge and agree that you have reviewed this site and these terms and that you will continue to review to be aware of any modifications.

 

We reserve the right to change these terms and conditions; or impose new conditions on the use our site from time to time, in which case we will post the revised terms and conditions on this page.
